⇒ The Code of Civil Procedure, 1908-এর Section 55(1)-এর চতুর্থ প্রভিশন (Provided, fourthly) স্পষ্টভাবে বলা আছে: where the decree in execution of which a judgment-debtor is arrested, is a decree for the payment of money and the judgment-debtor pays the amount of the decree and the costs of the arrest to the officer arresting him, such officer shall at once release him.
- অর্থাৎ, গ্রেপ্তারের সময়ই যদি জজমেন্ট-ডেবটর পুরো ডিক্রির টাকা + গ্রেপ্তারের খরচ গ্রেপ্তারকারী অফিসারকে পরিশোধ করে, তাহলে অফিসারকে তৎক্ষণাৎ (at once) তাকে মুক্তি দিতে হবে। আদালতে নেওয়ার বা অনুমতি নেওয়ার কোনো প্রয়োজন নেই।
- সুতরাং সঠিক উত্তর: ঘ) তাকে তৎক্ষণাৎ মুক্তি দিতে হবে।

⇒ The Code of Civil Procedure, 1908: Section-55.- Arrest and detention:
(1) A judgment-debtor may be arrested in execution of a decree at any hour and on any day, and shall, as soon as practicable, be brought before the Court, and his detention may be in the civil prison of the district in which the Court ordering the detention is situate, or, where such civil prison does not afford suitable accommodation, in any other place which the Government may appoint for the detention of persons ordered by the Courts of such district to be detained:
Provided, firstly, that, for the purpose of making an arrest under this section, no dwelling-house shall be entered after sunset and before sunrise:
Provided, secondly, that no outer door of a dwelling-house shall be broken open unless such dwelling-house is in the occupancy of the judgment-debtor and he refuses or in any way prevents access thereto, but when the officer authorised to make the arrest has duly gained access to any dwelling-house, he may break open the door of any room in which he has reason to believe the judgment-debtor is to be found:
Provided, thirdly, that, if the room is in the actual occupancy of a woman who is not the judgement-debtor and who according to the customs of the country does not appear in public, the officer authorised to make the arrest shall give notice to her that she is at liberty to withdraw, and, after allowing a reasonable time for her to withdraw and giving her reasonable facility for withdrawing, may enter the room for the purpose of making the arrest:

Provided, fourthly, that, where the decree in execution of which a judgment-debtor is arrested, is a decree for the payment of money and the judgment-debtor pays the amount of the decree and the costs of the arrest to the officer arresting him, such officer shall at once release him.

(2) The Government may, by notification in the official Gazette, declare that any person or class of persons whose arrest might be attended with danger or inconvenience to the public shall not be liable to arrest in execution of a decree otherwise than in accordance with such procedure as may be prescribed by the Government in this behalf.
(3) Where a judgment-debtor is arrested in execution of a decree for the payment of money and brought before the Court, the Court shall inform him that he may apply to be declared an insolvent, and that he may be discharged if he has not committed any act of bad faith regarding the subject of the application and if he complies with the provisions of the law of insolvency for the time being in force.
(4) Where a judgment-debtor expresses his intention to apply to be declared an insolvent and furnishes security, to the satisfaction of the Court, that he will within one month so apply, and that he will appear, when called upon, in any proceeding upon the application or upon the decree in execution of which he was arrested, the Court may release him from arrest, and, if he fails so to apply and to appear, the Court may either direct the security to be realized or commit him to the civil prison in execution of the decree.

• তামাদি আইনের ৬,৭,৮ এবং ৯ ধারায় আইনগত অপারগতার নিয়ম উল্লেখ করা হয়েছে। তামাদি আইনের ৬ ধারায় বৈধ অপারগতা (Legal disability) নিয়ে সরাসরি আলোচনা করেছে। যেখানে বলা আছে, যে ক্ষেত্রে মামলা কিংবা কার্যব্যবস্থা কিংবা ডিক্রি জারির জন্য কোন ব্যক্তির বিরুদ্ধে তামাদি মেয়াদ গণনা শুরু হয় সেই সময় উক্ত ব্যক্তি যদি নাবালক, উন্মাদ বা চরম বুদ্ধিহীনতার রোগে ভুগে থাকে তবে তার বিরুদ্ধে তামাদি মেয়াদ গণনা স্থগিত থাকবে।

যখন উক্ত ব্যক্তির জীবন হতে অপারগতা অবসান হবে তখন তামাদি মেয়াদ গণনা আরম্ভ হবে। যদি একটি অপারগতা অবসান হবার আগেই আরেকটি অপারগতায় উক্ত ব্যক্তি আক্রান্ত হন তবে দুটি শেষ হবার পর তামাদি মেয়াদ গণনা শুরু হবে। এর মাঝে যদি উক্ত ব্যক্তি মৃত্যুবরণ করে তাহলে তার আইনগত প্রতিনিধির উপর তামাদি মেয়াদ গণনা শুরু হবে। তার আইনগত প্রতিনিধি যদি বৈধ অপারগতায় আক্রান্ত থাকেন তবে প্রতিনিধির আইনগত অপারগতা অবসান হবার পর তামাদি মেয়াদ গণনা আরম্ভ হবে।

তামাদি আইনের ৬ ধারার এই বিধান আপীল, রিভিউ, রিভিশন বা আবেদন ইত্যাদি ক্ষেত্রে প্রযোজ্য না। বৈধ অপারগতার বিধান শুধুমাত্র বাদী’র ক্ষেত্রে প্রযোজ্য। বিবাদী’র জন্য তামাদি আইনে বৈধ অপারগতার বিধান গ্রহণযোগ্য না।

⇒ ফৌজদারি কার্যবিধি, ১৮৯৮-এর ধারা ১৫০-তে স্পষ্টভাবে বলা হয়েছে যে, কোনো পুলিশ অফিসার যদি কোনো আমলযোগ্য অপরাধ সংঘটনের ষড়যন্ত্র বা পরিকল্পনার সংবাদ পান, তাহলে তিনি তা তাঁর ঊর্ধ্বতন পুলিশ কর্মকর্তা এবং যে কোনো অন্য কর্মকর্তাকে (যার দায়িত্ব সেই অপরাধ প্রতিরোধ করা বা তাতে আমল গ্রহণ করা) অবহিত করতে বাধ্য।

⇒ ফৌজদারি কার্যবিধির ১৫০ ধারার বিধান- অনুরূপ অপরাধের ষড়যন্ত্র সম্পর্কে সংবাদ: 
কোনো আমলযোগ্য অপরাধ সংঘটনের পরিকল্পনা সম্পর্কে তথ্য প্রাপ্ত প্রত্যেক পুলিশ কর্মকর্তা উক্ত তথ্য তার উর্ধ্বতন পুলিশ কর্মকর্তাকে এবং অন্য যেকোনো কর্মকর্তাকে, যার দায়িত্ব হলো এরূপ অপরাধ সংঘটন প্রতিরোধ করা বা এ বিষয়ে আমল গ্রহণ করা, তাকে জানাতে বাধ্য থাকবেন।

⇒ The Code of Criminal Procedure, 1898, Section 150- Information of design to commit such offences:
Every police-officer receiving information of a design to commit any cognizable offence shall communicate such information to the police-officer to whom he is subordinate, and to any other officer whose duty it is to prevent or take cognizance of the commission of any such offence.

⇒দেওয়ানি কার্যবিধির আদেশ ২০ বিধি ১ (Order XX Rule 1) অনুসারে, মোকদ্দমার শুনানি শেষ হওয়ার পর আদালত সর্বোচ্চ ৭ দিনের মধ্যে রায় ঘোষণা করতে বাধ্য। বিধিতে স্পষ্টভাবে উল্লেখ আছে: "তৎক্ষণাৎ কিংবা ভবিষ্যত কোন দিনে, যা সাতদিনের বেশি হবে না" (either at once or on some future day, not beyond seven days)।

⇒ দেওয়ানি কার্যবিধির আদেশ ২০ বিধি ১:-
মোকদ্দমার শুনানি সমাপ্ত হওয়ার পর আদালতে তৎক্ষণাৎ কিংবা ভবিষ্যত কোন দিনে ,পক্ষগণের বা তাদের উকিলগণের উপর যথাযথ বিজ্ঞপ্তি প্রদান করার পর যা সাতদিনের বেশি হবে না প্রকাশ্য আদালতে রায় ঘোষণা করবে।

⇒ The Code of Civil Procedure,1908, Order 20 Rule 1: Judgment when pronounced:-
The Court, after the case has been heard, shall pronounce judgment in open Court, either at once or on some future day, not beyond seven days, of which due notice shall be given to the parties or their pleaders.

সুনির্দিষ্ট প্রতিকার আইনের বিষয়বস্তু (Subject matter of Specific Relief Act):
১৮৭৭ সালের সুনির্দিষ্ট প্রতিকার আইনটি ১০টি অধ্যায়ে (Chapter) বিভক্ত এবং এতে মোট ৫৭টি ধারা (Section) সন্নিবেশিত রয়েছে। 

অধ্যায়সমূহ:
⇒ সম্পত্তির দখল পুনরুদ্ধার (Recovering possession of property)- ধারা (৮-১১);
⇒ চুক্তির সুনির্দিষ্ট সম্পাদন (Specific performance of contract)- ধারা (১২-৩০);
⇒ দলিল সংশোধন (Rectification of Instruments)- ধারা (৩১-৩৪);
⇒ চুক্তি রদ (Rescission of a contract)- ধারা (৩৫-৩৮);
⇒ দলিল বাতিল (Cancellation of instrument)- ধারা (৩৯-৪১);
⇒ ঘোষণামূলক ডিক্রি (Declaratory Decree)- ধারা (৪২-৪৩);
⇒ তত্ত্বাবধায়ক নিয়োগ (Appointment of receiver)- ধারা ৪৪;
⇒ বিলুপ্ত (Omitted)- ধারা (৪৫-৫১);
⇒ সাধারণভাবে নিষেধাজ্ঞা (Injunction generally)- ধারা (৫২-৫৩);
⇒ চিরস্থায়ী নিষেধাজ্ঞা (Perpetual injunction)- ধারা (৫৪-৫৭)।

⇒ দণ্ডবিধির ৪৯ ধারা স্পষ্টভাবে উল্লেখ করে যে, "year" বা "month" শব্দ ব্যবহৃত হলে তা ইংরেজি ক্যালেন্ডার (অথবা গ্রেগরিয়ান ক্যালেন্ডার) অনুযায়ী গণনা করা হবে।
- ইংরেজি ক্যালেন্ডারে এক বছর ৩৬৫ দিন (অথবা লিপ বছরের ক্ষেত্রে ৩৬৬ দিন) এবং এক মাস ৩০ বা ৩১ দিন (ফেব্রুয়ারিতে ২৮ বা ২৯ দিন) হিসেবে গণনা করা হয়।

অর্থাৎ, দণ্ডবিধিতে "বছর" বা "মাস" গণনা করা হয় ব্রিটিশ ক্যালেন্ডার (গ্রেগরিয়ান ক্যালেন্ডার) অনুযায়ী।
- সঠিক উত্তর: গ) ব্রিটিশ ক্যালেন্ডার অনুযায়ী।

⇒ The Penal Code, 1860- Sections- 49.“Year” “Month”:
- Wherever the word "year" or the word "month" is used, it is to be understood that the year or the month is to be reckoned according to the British calendar.

The Civil Courts Act, 1887 এর ধারা ২২: জেলা জজের আপিল স্থানান্তরের ক্ষমতা:
(১) জেলা জজ, তার প্রশাসনিক নিয়ন্ত্রণাধীন যে কোনো যুগ্ম জেলা জজের নিকট, তার নিকটে মুলতুবি থাকা এবং সিনিয়র সহকারী জজ বা সহকারী জজ কর্তৃক প্রদত্ত ডিক্রি বা আদেশ থেকে উদ্ভূত যে কোনো আপিল স্থানান্তর করতে পারবেন।

(২) জেলা জজ, এভাবে স্থানান্তরিত কোনো আপিল প্রত্যাহার করে তা নিজে শুনানি ও নিষ্পত্তি করতে পারবেন অথবা তার প্রশাসনিক নিয়ন্ত্রণাধীন অন্য কোনো উপযুক্ত আদালতে স্থানান্তর করতে পারবেন।

(৩) এই ধারার অধীনে স্থানান্তরিত আপিলসমূহ সেই নিয়ম অনুসারে নিষ্পত্তি করা হবে, যেভাবে জেলা জজ কর্তৃক নিষ্পত্তিকৃত অনুরূপ আপিলের ক্ষেত্রে প্রযোজ্য হয়।

[Power of District Judge to transfer appeals]
(1) A District Judge may transfer to any Joint District Judge under his administrative control any appeals pending before him from the decrees or orders of Senior Assistant Judges or Assistant Judges.

(2) The District Judge may withdraw any appeal so transferred, and either hear and depose of it himself or transfer it to a Court under his administrative control competent to dispose of it. 
 
(3) Appeals transferred under this section shall be disposed of subject to the rules applicable to like appeals when disposed of by the District Judge.

আদেশ ১৪ বিধি ৩ মতে- বিচার্য বিষয় প্রণয়নের তিনটি উৎস:
- শপথভিত্তিক মৌখিক অভিযোগ;
- আরজি-জবাব ও প্রশ্নমালার লিখিত অভিযোগ;
- দাখিলকৃত দলিলপত্র।

আদালত নিম্নলিখিত বিষয়গুলোর সকল কিংবা যে কোনটি থেকে বিচার্য বিষয় প্রণয়ন করতে পারেন [Materials from which issues may be framed]—
ক) পক্ষগণ কর্তৃক কিংবা তাদের পক্ষে উপস্থিত কোন ব্যক্তিগণ কর্তৃক কিংবা উত্তরূপ ব্যক্তিসমূহের উকিলগণ কর্তৃক শপথের মাধ্যমে উত্থাপিত অভিযোগসমূহ,
[allegations made on faith by the parties, or by any persons present on their behalf, or made by the pleaders of such parties]

খ) আরজি জবাবে কিংবা মোকদ্দমায় প্রদত্ত প্রশ্নমালার উত্তরে রচিত অভিযোগসমূ্‌হ,
[allegations made in the pleadings or in answers to interrogatories delivered in the suit]

গ) কোন পক্ষ কর্তৃক দাখিলকৃত দলিল পত্রের বিষয়বস্তু। 
[the contents of documents produced by either party]

⇒ দণ্ডবিধি, ১৮৬০-এর ধারা ৪০৫ অনুসারে, অপরাধমূলক বিশ্বাসভঙ্গ (Criminal Breach of Trust) হলো যখন কোনো ব্যক্তি, যিনি কোনো সম্পত্তি বা সম্পত্তির উপর নিয়ন্ত্রণের দায়িত্বপ্রাপ্ত হয়েছেন, অসৎ উদ্দেশ্যে সেই সম্পত্তি আত্মসাৎ করে, নিজের ব্যবহারে প্রয়োগ করে, বা আইনি নির্দেশ বা চুক্তি লঙ্ঘন করে সেই সম্পত্তি ব্যবহার বা নিষ্পত্তি করে, অথবা ইচ্ছাকৃতভাবে অন্য কাউকে তা করতে দেয়। এই অপরাধের মূল উপাদান হলো:
দায়িত্বপ্রাপ্ত হওয়া (Entrustment): ব্যক্তিকে সম্পত্তি বা তার উপর নিয়ন্ত্রণের দায়িত্ব দেওয়া হয়েছে।
অসাধুতা (Dishonesty): সম্পত্তি আত্মসাৎ, ব্যবহার বা নিষ্পত্তি অসৎ উদ্দেশ্যে করা হয়।
আইন বা চুক্তি লঙ্ঘন: সম্পত্তির ব্যবহার বা নিষ্পত্তি আইনের নির্দেশ বা প্রকাশ্য/অপ্রকাশ্য চুক্তির বিপরীত হতে হবে।
ইচ্ছাকৃতভাবে অন্যকে অনুমতি দেওয়া: ইচ্ছাকৃতভাবে অন্য কাউকে সম্পত্তি অসাধুভাবে ব্যবহার করতে দেওয়াও এই অপরাধের আওতায় পড়ে।
অর্থাৎ অপরাধমূলক বিশ্বাসভঙ্গের মূল উপাদান হলো অসৎ উদ্দেশ্যে দায়িত্বপ্রাপ্ত সম্পত্তি আত্মসাৎ বা ব্যবহার করা, যা ধারা ৪০৫-এর সংজ্ঞার সাথে সামঞ্জস্যপূর্ণ।

⇒ দণ্ডবিধির ৪০৫ ধারার বিধান অপরাধমূলক বিশ্বাসভঙ্গ:- কোন ব্যক্তি যদি কোনভাবে কোন সম্পত্তির বা সম্পত্তি পরিচালনের দায়িত্বপ্রাপ্ত হয়ে, অসাধুভাবে সে সম্পত্তি আত্মসাৎ করে বা নিজের ব্যবহারে প্রয়োগ করে, অথবা অনুরূপ দায়িত্ব যেভাবে নির্বাহিত হত বলে বিহিত আইনে নির্দেশ করা হয়েছে, তা খেলাফ করে সে দায়িত্ব নির্বাহ সম্পর্কে সে প্রকাশ্য বা অনুরূপ যে আইনগত চুক্তি করেছে তা খেলাফ করে সে সম্পত্তি অসাধুভাবে ব্যবহার করে, বা বিলি ব্যবস্থা করে অথবা ইচ্ছাপূর্বক অপর কোন ব্যক্তিকে তা করতে দেয়, তবে উক্ত ব্যক্তি 'অপরাধমূলক বিশ্বাসভঙ্গের' অপরাধ করেছে।

⇒The Penal Code, 1860,-Section 405. Criminal breach of trust:
 Whoever, being in any manner entrusted with property, or with any dominion over property, dishonestly misappropriates or converts to his own use that property, or dishonestly uses or disposes of that property in violation of any direction of law prescribing the mode in which such trust is to be discharged, or of any legal contract, express or implied, which he has made touching the discharge of such trust, or wilfully suffers any other person so to do, commits "criminal breach of trust".

Rule.-4: Order for injunction may be discharged, varied or set aside:
Any order for an injunction may be discharged, or varied, or set aside by the Court, on application made thereto by any party dissatisfied with such order.

আদেশ ৩৯ বিধি-৪: নিষেধাজ্ঞার আদেশ মুক্ত, পরিবর্তন বা বাতিল হতে পারে:
নিষেধাজ্ঞার কোন আদেশ অনুরূপ আদেশে কোন পক্ষ অসন্তুষ্ট হলে সে পক্ষের আবেদনক্রমে আদালত কর্তৃক উক্ত নিষেধাজ্ঞার আদেশ মুক্ত বা পরিবর্তন বা বাতিল হতে পারে।

⇒ ফৌজদারী কার্যবিধির ৩১ ধারার বিধান- হাইকোর্ট ও দায়রা জজ যেসব দণ্ড দিতে পারেন:
(১) হাইকোর্ট বিভাগ আইনে অনুমোদিত যে কোন দণ্ড দিতে পারেন।

(২) দায়রা জজ বা অতিরিক্ত দায়রা জজ আইনে অনুমোদিত যে কোন দণ্ড দিতে পারেন; তবে এরূপ কোন মৃত্যুদণ্ড প্রদান করলে তা হইকোর্ট ডিভিশনের অনুমোদন সাপেক্ষে হবে।

(৩) যুগ্ম দায়রা জজ মৃত্যুদণ্ড বা যাবজ্জীবন কারাদণ্ড বা দশ বৎসরের অধিক কারাদণ্ড ব্যতিরেকে আইনে অনুমোদিত যে কোন দণ্ড দিতে পারেন।

ধারা ৪১৩- তুচ্ছ মামলায় আপিল নয়:
এতে পূর্বে যা কিছু অন্তর্ভুক্ত থাকুক না কেন, যে মামলাগুলিতে একটি দায়রা আদালত শুধুমাত্র এক মাসের বেশি নয় এমন কারাদণ্ড প্রদান করেন, বা যে মামলাগুলিতে একটি দায়রা আদালত বা [চিফ জুডিশিয়াল ম্যাজিস্ট্রেট] [বা মেট্রোপলিটন ম্যাজিস্ট্রেট] বা প্রথম শ্রেণির অন্য কোনো ম্যাজিস্ট্রেট শুধুমাত্র [পাঁচ হাজার টাকা] এর বেশি নয় এমন জরিমানা প্রদান করেন, সেই মামলাগুলিতে দোষী সাব্যস্ত ব্যক্তির কোনো আপিল চলবে না।

ব্যাখ্যা: যখন জরিমানা অনাদায়ে কারাদণ্ডের কোনো মূল সাজা (substantive sentence) দেওয়া হয়নি, তখন ওই আদালত বা ম্যাজিস্ট্রেট কর্তৃক প্রদত্ত জরিমানা অনাদায়ে কারাদণ্ডের রায়ের বিরুদ্ধে কোনো আপিল চলবে না।

⇒ The Civil Courts Act,1887 আইনের ৩৭ ধারায় কতিপয় বিষয়ে রাষ্ট্রীয় আইন নয় বরং হিন্দু এবং মুসলিমদের ধর্মীয় আইনের বিধানকে সংরক্ষণ করা হয়েছে।
⇒ The Civil Courts Act, 1887-এর ধারা ৩৭(১) অনুসারে, কোনো মামলা বা কার্যক্রমে যদি উত্তরাধিকার (Succession), বিবাহ (Marriage), জাতি (Caste), বা ধর্মীয় প্রথা ও প্রতিষ্ঠান (Religious Usage or Institution) সংক্রান্ত কোনো প্রশ্নের সিদ্ধান্ত নেওয়ার প্রয়োজন হয়, তবে পক্ষগুলোর ধর্মীয় পরিচয়ের ভিত্তিতে আইন প্রয়োগ করা হয়। বিশেষ করে:
- যদি পক্ষগুলো মুসলিম হয়, তবে মুসলিম আইন প্রয়োগ করা হবে।
- যদি পক্ষগুলো হিন্দু হয়, তবে হিন্দু আইন প্রয়োগ করা হবে।
এই ক্ষেত্রে, প্রশ্নে উল্লিখিত হিন্দু পক্ষগুলোর (Hindu parties) ধর্মীয় প্রথা (Religious Usage) সংক্রান্ত বিষয়ে সিদ্ধান্ত গ্রহণের জন্য হিন্দু আইন প্রযোজ্য হবে, যদি না সেই আইন কোনো আইনসভার দ্বারা পরিবর্তিত বা বাতিল করা হয়।

- ধারা ৩৭(২) অনুসারে, যদি ধারা ৩৭(১) বা অন্য কোনো প্রচলিত আইন প্রযোজ্য না হয়, তবে আদালত ন্যায়, ইক্যুইটি এবং সৎ বিবেক (Justice, Equity, and Good Conscience) অনুযায়ী সিদ্ধান্ত নেবে। তবে, হিন্দু পক্ষগুলোর ধর্মীয় প্রথা সংক্রান্ত বিষয়ে হিন্দু আইনই প্রাথমিকভাবে প্রযোজ্য।

⇒ The Civil Courts Act,1887-এর ধারা ৩৭(১) অনুসারে, হিন্দু পক্ষগুলোর ধর্মীয় প্রথা সংক্রান্ত বিষয়ে সিদ্ধান্ত গ্রহণে হিন্দু আইন প্রয়োগ করা হবে। তাই সঠিক উত্তর হলো গ) Hindu law অনুযায়ী।

⇒ The Civil Courts Act,1887, Section 37- Certain decisions to be according to local law:
(1) Where in any suit or other proceeding it is necessary for a Civil Court to decide any question regarding succession, inheritance, marriage or caste, or any religious usage or institution, the Muslim law in cases where the parties are Muslim, and the Hindu law in cases where the parties are Hindus, shall form the rule of decision except in so far as such law has, by legislative enactment, been altered or abolished.
(2) In cases not provided for by sub-section (1) or by any other law for the time being in force, the Court shall act according to justice, equity and good conscience.

⇒ দণ্ডবিধির ২১২ ধারার বিধান- অপরাধীকে আশ্রয় দেওয়া, অপরাধটি মৃত্যুদণ্ডে দণ্ডনীয় হইলে:
কোন অপরাধ অনুষ্ঠিত হওয়ার পর কোন ব্যক্তি যদি কাউকে দোষী বলে জ্ঞাত করা থাকা সত্ত্বেও অথবা সে দোষী বলে বিশ্বাস করার কারণ থাকা সত্ত্বেও তাকে আইনের সাজা হতে বাঁচাবার উদ্দেশ্যে লুকিয়ে রাখে বা আশ্রয়দান করে, সেক্ষেত্রে-

- দোষী ব্যক্তি যদি মৃত্যুদণ্ডে দণ্ডনীয় হয়:-
যদি অপরাধটি মৃত্যুদণ্ডে দণ্ডনীয় হয়, তবে সে ব্যক্তি পাঁচ বৎসর পর্যন্ত যেকোন মেয়াদের সশ্রম বা বিনাশ্রম কারাদণ্ডে দণ্ডিত হবে এবং তাকে অর্থদণ্ডেও দণ্ডিত করা যাবে।

- দোষী ব্যক্তি যদি যাবজ্জীবন কারাদণ্ড অথবা কারাদণ্ডে দণ্ডনীয় হয়:-
যদি অপরাধটি যাবজ্জীবন কারাদণ্ডে কিংবা দশ বৎসর পর্যন্ত যেকোন মেয়াদের কারাদণ্ডে দণ্ডনীয় হয়, তবে সে ব্যক্তি তিন বৎসর পর্যন্ত সশ্রম বা বিনাশ্রম কারাদণ্ডে দণ্ডিত হবে এবং তাকে অর্থদণ্ডেও দণ্ডিত করা যাবে।
যদি অপরাধটি এক বৎসর পর্যন্ত যেকোন মেয়াদের কারাদণ্ডে দণ্ডনীয় হয় এবং দশ বৎসর পর্যন্ত যেকোন মেয়াদের কারাদণ্ডে দণ্ডনীয় না হয়, তবে সে ব্যক্তি সে অপরাধটির জন্য বিহিত প্রকারের কারাদণ্ডের দীর্ঘতম মেয়াদের এক-চতুর্থাংশ পর্যন্ত যেকোন মেয়াদের কারাদণ্ডে দণ্ডিত হবে অথবা অর্থ দণ্ডে দণ্ডিত হবে অথবা উভয়বিধ দণ্ডেই দণ্ডিত হবে।

অত্র ধারার অপরাধ বলতে বাংলাদেশের মধ্যে যে কাজ অনুষ্ঠিত হলে তা ৩০২, ৩০৪, ৩৮২, ৩৯২, ৩৯৩, ৩৯৪, ৩৯৫, ৩৯৬, ৩৯৭, ৩৯৮, ৩৯৯, ৪০২, ৪৩৫, ৪৩৬, ৪৪৯, ৪৫০, ৪৫৭, ৪৫৮, ৪৫৯ এবং ৪৬০ ধারায় যে কোনটি অনুযায়ী দণ্ডনীয় হত, তা বাংলাদেশের বাইরে যেকোন স্থানে অনুষ্ঠিত হলে তাকেও বুঝাবে এবং অনুরূপ যেকোন কাজ যেন অভিযুক্ত ব্যক্তি বাংলাদেশের অভ্যন্তরেই সংঘটনের জন্য দোষী সাব্যস্ত হয়েছে, এমনভাবেই দণ্ডনীয় বলে পরিগণিত হবে।

ব্যতিক্রম:- দোষী ব্যক্তির স্বামী বা স্ত্রী অনুরূপ আশ্রয়দান করলে বা লুকিয়ে রাখলে তখন এই বিধান প্রয়োগযোগ্য হবে না।

The Bangladesh Legal Practitioners and Bar Council Orders, 1972 এর অনুচ্ছেদ ১৬:
(১) বার কাউন্সিল নির্ধারিত ফরমে ও পদ্ধতিতে হিসাব বহি ও অন্যান্য বহি সংরক্ষণ করিবে।
(২) বার কাউন্সিলের হিসাব একজন নিরীক্ষক কর্তৃক, নির্ধারিত সময় এবং পদ্ধতিতে, নিরীক্ষিত হইতে হইবে, যিনি 'কোম্পানি আইন, ১৯৯৪ (১৯৯৪ সনের ১৮ নং আইন)] এর অধীন কোম্পানির নিরীক্ষা করিবার যথাযথ যোগ্য নিরীক্ষকগণের মধ্য হইতে বার কাউন্সিল কর্তৃক নিযুক্ত হইবেন।
(৩) দফা (২) এর অধীন নিরীক্ষিত হিসাব সংসদ সচিবালয়ের মাধ্যমে সংসদের পাবলিক একাউন্টন্স কমিটির নিকট পেশ করিতে হইবে।

Section 16: (1) The Bar Council shall cause to be maintained such books of accounts and other books in such form and in such manner as may be prescribed.
(2) The accounts of the Bar Council shall be audited by an auditor, who shall be appointed by the Bar Council from amongst auditors duly qualified to act as auditors of companies under the 16[Companies Act, 1994 (Act 18 of 1994)], at such time and in such manner as may be prescribed.
(3) The audited accounts of the Bar Council under clause (2) shall be submitted to the Public Accounts Committee of the Parliament through the Parliament Secretariat.

⇒ The Bangladesh Legal Practitioners and Bar Council Order, 1972-এর ১১ অনুচ্ছেদে ৩ ধরনের স্থায়ী কমিটির (Standing Committees] উল্লেখ আছে।

⇒ বাংলাদেশ লিগ্যাল প্র্যাকটিশনারস এবং বার কাউন্সিল অর্ডার, ১৯৭২ এর ১১(১) অনুচ্ছেদে বলা হয়েছে, বার কাউন্সিল নিম্নলিখিত স্থায়ী কমিটি নিয়ে গঠিত হবে:
১. নির্বাহী কমিটি;
২. আর্থিক কমিটি;
৩. আইন শিক্ষা কমিটি।

Article-11(1): The Bar Council shall constitute the following standing committees namely:-
(a) an executive committee consisting of five members elected by the Council from amongst its members;
(c) a finance committee consisting of five members elected by the Council from amongst its members;
(d) a legal education committee consisting of nine members-five elected by the Council from amongst its members and four co-opted by the Council from persons other than the members of the Council at least two of whom shall be teachers of law in any university or college in Bangladesh.

⇒ দেওয়ানি কার্যবিধি, ১৯০৮ এর ধারা ৬ মূলত আদালতের আর্থিক এখতিয়ার (Pecuniary Jurisdiction) নিয়ে আলোচনা করে।
- এই ধারার ভাষ্য অনুযায়ী, যদি অন্য কোনো আইন বা বিধানে স্পষ্টভাবে কিছু না বলা থাকে, তাহলে কোন আদালত এমন কোন মামলার বিচার করতে পারবে না যার বিষয়বস্তুর মূল্য (amount or value of subject-matter) তার সাধারণ আর্থিক সীমার (ordinary pecuniary jurisdiction) চেয়ে বেশি।
→ অর্থাৎ, প্রতিটি দেওয়ানি আদালতের একটি নির্দিষ্ট আর্থিক সীমা থাকে এবং সেই সীমার বাইরে মামলার বিচার করার এখতিয়ার সেই আদালতের নেই — যদি না অন্য কোনো আইন তাকে সে ক্ষমতা দেয়।

⇒ দেওয়ানি কার্যবিধির ৬ ধারায় আর্থিক এখতিয়ার সম্পর্কে বলা আছে:
অন্যত্র বর্ণিত সুস্পষ্ট বিধানসমূহ ছাড়া এই আইনের বিধান কোন আদালতকে তার সাধারণ এখতিয়ারের আর্থিক সীমারেখার (যদি থাকে) বেশি মূল্যসম্পন্ন বিষয়বস্তু সম্পর্কিত মোকদ্দমার বিচার করার এখতিয়ার প্রদান করবে না।
⇒ The Code of Civil Procedure, 1908 Section- 6: Pecuniary Jurisdiction:-
Save in so far as is otherwise expressly provided, nothing herein contained shall operate to give any Court jurisdiction over suits the amount or value of the subject-matter of which exceeds the pecuniary limits (if any) of its ordinary jurisdiction.

⇒ দেওয়ানী কার্যবিধি অনুযায়ী মধ্যস্থতা (Mediation) প্রক্রিয়া সর্বোচ্চ ৯০ দিনের মধ্যে সম্পন্ন করতে হবে।

মধ্যস্থতার শুরু: লিখিত জবাব দাখিলের পর আদালত মামলার বিরোধ নিজেই মধ্যস্থতা করতে পারে বা মধ্যস্থতাকারীর নিকট পাঠাতে পারে।

মধ্যস্থতাকারী নিয়োগ:
- আদালতের আদেশ প্রদানের ১০ দিনের মধ্যে পক্ষদ্বয় মধ্যস্থতাকারী নিয়োগ দিবে।
- যদি না পারেন, পরবর্তী ৭ দিনের মধ্যে আদালত নিয়োগ দিবে।
- অর্থাৎ সর্বোচ্চ ১৭ দিনের মধ্যে মধ্যস্থতাকারী নিয়োগ নিশ্চিত হবে।

মীমাংসার সময়সীমা:
- নিয়োগের ৬০ দিনের মধ্যে মীমাংসা করতে হবে।
- প্রয়োজনে আরও ৩০ দিন বাড়ানো যেতে পারে।
- সর্বাধিক সময়: ৬০ + ৩০ = ৯০ দিন।

পরবর্তী প্রক্রিয়া:
- মধ্যস্থতা প্রতিবেদন প্রাপ্তির ৭ দিনের মধ্যে আদালত সোলে ডিক্রি (Compromise Decree) জারি করবে।
সুতরাং, পুরো মধ্যস্থতা প্রক্রিয়া সর্বাধিক ৯০ দিনের মধ্যে সম্পন্ন করতে হবে।

- সঠিক উত্তর: গ) ৯০ দিন। 

⇒ দণ্ডবিধির ধারা ৩৪৬-এ "গোপনে অবৈধ অবরোধ" (Wrongful Confinement in Secret)-এর বিধান রয়েছে। এই ধারা অনুযায়ী, যদি কোনো ব্যক্তি অবৈধভাবে অন্য কাউকে এমনভাবে আটকে রাখে যাতে বন্দী ব্যক্তির সম্পর্কিত কোনো ব্যক্তি বা কোনো সরকারি কর্মচারী এটি জানতে না পারে বা বন্দী ব্যক্তির অবস্থান খুঁজে না পায়, তবে তা এই ধারার অধীনে শাস্তিযোগ্য অপরাধ।

⇒ দণ্ডবিধির ৩৪৬ ধারার বিধান- গোপনে অবৈধ অবরোধ:
- কোন ব্যক্তি যদি কাউকে অবৈধভাবে বন্দি রাখে, তাতে এইরূপ একটি উদ্দেশ্য সূচিত হয় যে, বন্দি ব্যক্তিকে আটক করে রাখার ব্যাপারটি বন্দি ব্যক্তির সাথে স্বার্থসংশ্লিষ্ট কোন ব্যক্তির বা কোন সরকারী কর্মচারীর গোচরীভূত হবে না, অথবা যে স্থানে অনুরূপ বন্দি করে রাখা হয়েছে সে স্থানটি উপযুক্তরূপ কোন ব্যক্তি বা সরকারী কর্মচারী দ্বারা জ্ঞাত বা আবিষ্কৃত হবে না, তবে উক্ত ব্যক্তি অনুরূপ অবৈধভাবে বন্দি করে রাখার জন্য অপর যে দণ্ডে দণ্ডিত হবে, তদতিরিক্ত আরও দুই বৎসর পর্যন্ত যে কোন মেয়াদের সশ্রম বা বিনাশ্রম কারাদণ্ডে দণ্ডিত হবে।

⇒ The Penal Code, 1860 Section 346. Wrongful confinement in secret:
-Whoever wrongfully confines any person in such manner as to indicate an intention that the confinement of such person may not be known to any person interested in the person so confined, or to any public servant, or that the place of such confinement may not be known to or discovered by any such person or public servant as hereinbefore mentioned, shall be punished with imprisonment of either description for a term which may extend to two years in addition to any other punishment to which he may be liable for such wrongful confinement.

⇒ দেওয়ানি কার্যবিধির ধারা ২(২) অনুসারে "ডিক্রি" এর সংজ্ঞাটি স্পষ্টভাবে কিছু বিষয় অন্তর্ভুক্ত এবং বাদ দিয়েছে।
- এটি নিম্নলিখিত বিষয়গুলোকে অন্তর্ভুক্ত করবে বলে গণ্য করা হয়:
ক) আরজি বাতিল (Rejection of a plaint)
গ) ধারা ১৪৪-এর অধীন কোনো প্রশ্নের নির্ধারণ (Determination of question under section 144)
- এটি নিম্নলিখিত বিষয়গুলো অন্তর্ভুক্ত করবে না:
খ) ত্রুটির জন্য খারিজের কোনো আদেশ (any order of dismissal for default) এটি সরাসরি অপশন খ এর সাথে মিলে যায়।

⇒ The Code of Civil Procedure, 1908, Section 2(2)-
"decree" means the formal expression of an adjudication which, so far as regards the Court expressing it, conclusively determines the rights of the parties with regard to all or any of the matters in controversy in the suit and may be either preliminary or final. It shall be deemed to include the rejection of a plaint and the determination of any question within section 144,
but shall not include- 
(a) any adjudication from which an appeal lies as an appeal from an order, or 
(b) any order of dismissal for default.

⇒ দেওয়ানি কার্যবিধির ধারা ২(২) অনুসারে-
ডিক্রি বলতে কোন আদালত কর্তৃক  আনুষ্ঠানিকভাবে ভাবে প্রকাশিত এমন বক্তব্য বুঝায়, যা মোকদ্দমার বিতর্কিত সমগ্র বা যেকোন বিষয় সম্পর্কে পক্ষগণের অধিকার চূড়ান্তভাবে নির্ধারণ করে এবং এই “ডিক্রি” প্রাথমিক বা চূড়ান্ত হতে পারে। নিম্নলিখিত বিষয় ডিক্রি হিসেবে অন্তর্ভুক্ত হবে-  আদেশ ৭ বিধি ১১ এর অধীন আরজি প্রত্যাখ্যান এবং ১৪৪ ধারায় বর্ণিত কোন প্রশ্ন নির্ধারণও ডিক্রি বলে গণ্য হবে।

⇒ তবে নিম্নলিখিত বিষয় এর অন্তর্ভুক্ত হবে না:
- যে বিচারকৃত রায়ের বিরুদ্ধে কোন আদেশের বিরুদ্ধে আপিলের মত আপিল করা যায়; অথবা
- কোন ত্রুটির জন্য খারিজের আদেশ।

The Bangladesh legal practitioners and Bar council orders 1972 অনুচ্ছেদ ৫ক(১) অনুসারে কোনো এডভোকেট একাধারে দুইবারের অধিক বার কাউন্সিলের সদস্য পদে অধিষ্ঠিত থাকিতে পারিবেন না।
(২) এই অনুচ্ছেদ কার্যকর হইবার অব্যবহিত পূর্বে কোনো এডভোকেট বার কাউন্সিলের সদস্য হিসাবে একাধারে দুইবার নির্বাচিত হইলে তিনি পরবর্তী মেয়াদের জন্য নির্বাচিত হইবার যোগ্য হইবেন না।

5A. (1) No Advocate shall hold office of member of the Bar Council for more than two consecutive terms.
(2) An Advocate who has been elected for two consecutive terms as a member of the Bar Council immediately before this Article comes into force shall not be eligible to be elected as a member of the Bar Council for the next term.

⇒ ফৌজদারি কার্যবিধি, ১৮৯৮ এর ধারা ৫১ এর শেষ অংশে স্পষ্টভাবে উল্লেখ আছে যে, গ্রেপ্তারকৃত ব্যক্তির কাছ থেকে কোনো জিনিস জব্দ করা হলে, অফিসার একজন সাক্ষীর উপস্থিতিতে একটি তালিকা প্রস্তুত করবেন এবং সম্ভব হলে তার স্বাক্ষর গ্রহণ করবেন।
- এখানে "a witness" (একজন সাক্ষী) বলা হয়েছে, "witnesses" (একাধিক সাক্ষী) নয়।
সুতরাং, তালিকা প্রস্তুত করার সময় মাত্র একজন সাক্ষীর উপস্থিতি আবশ্যক।

⇒ ফৌজদারী কার্যবিধি, ১৮৯৮-এর ধারা ৫১ - "গ্রেপ্তারকৃত ব্যক্তিদের তল্লাশি" (Search of arrested persons): যখনই কোনো ব্যক্তিকে একজন পুলিশ অফিসার এমন কোনো ওয়ারেন্টের অধীনে গ্রেপ্তার করেন যেখানে জামিনের বিধান নেই, অথবা এমন ওয়ারেন্টের অধীনে গ্রেপ্তার করেন যেখানে জামিনের বিধান আছে কিন্তু গ্রেপ্তারকৃত ব্যক্তি জামিন দিতে পারেন না, এবং যখনই কোনো ব্যক্তিকে ওয়ারেন্ট ছাড়াই গ্রেপ্তার করা হয়, বা কোনো বেসরকারি ব্যক্তি কর্তৃক ওয়ারেন্টের অধীনে গ্রেপ্তার করা হয়, এবং আইনত জামিনে মুক্ত হতে পারেন না, অথবা জামিন দিতে অক্ষম হন, তখন গ্রেপ্তারকারী অফিসার অথবা, যখন গ্রেপ্তার কোনো বেসরকারি ব্যক্তি দ্বারা করা হয়, তখন যে পুলিশ অফিসারের নিকট গ্রেপ্তারকৃত ব্যক্তিকে হস্তান্তর করা হয়, তিনি ওই ব্যক্তিকে তল্লাশি করতে পারেন এবং তার কাছে পাওয়া প্রয়োজনীয় পরিধেয় বস্ত্র ব্যতীত অন্যান্য সমস্ত জিনিসপত্র নিরাপদ হেফাজতে রাখতে পারেন ; এবং
যেখানে গ্রেপ্তারকৃত ব্যক্তির কাছ থেকে কোনো জিনিস জব্দ করা হয়, সেখানে অফিসার একজন সাক্ষীর উপস্থিতিতে একটি তালিকা প্রস্তুত করবেন এবং সম্ভব হলে তার স্বাক্ষর গ্রহণ করবেন, এবং এর একটি অনুলিপি গ্রেপ্তারকৃত ব্যক্তিকে বা তার দ্বারা মনোনীত কোনো ব্যক্তিকে সরবরাহ করবেন।

⇒ The Code of Criminal Procedure, 1898 Section- 51. Search of arrested persons:
Whenever a person is arrested by a police-officer under a warrant which does not provide for the taking of bail, or under a warrant which provides for the taking of bail but the person arrested cannot furnish bail, and Whenever a person is arrested without warrant, or by a private person under a warrant, and cannot legally be admitted to bail, or is unable to furnish bail, the officer making the arrest or, when the arrest is made by a private person, the police-officer to whom he makes over the person arrested, may search such person, and place in safe custody all articles, other than necessary wearing-apparel, found upon him ; and
where any article is seized from the arrested person, the officer shall prepare a list in the presence of a witness and obtain his signature, if practicable, and shall serve a copy thereof to the arrested person or to any person nominated by him.
