• সুনির্দিষ্ট প্রতিকার আইনের ২৭ ধারামতে-
যাদের বিরুদ্ধে চুক্তির সুনির্দিষ্ট বাস্তবায়ন করা যেতে পারে [specific performance of a contract may be enforced against]-
(a) either party thereto;
ব্যাখ্যা: একটি চুক্তির যেকোনো পক্ষের বিরুদ্ধে সেই চুক্তির নির্দিষ্ট বাস্তবায়ন করা যেতে পারে।
(b) any other person claiming under him by a title arising subsequently to the contract, except a transferee for value who has paid his money in good faith and without notice of the original contract;
ব্যাখ্যা: চুক্তির পরবর্তীতে যদি কেউ চুক্তির পক্ষের অধিকার দাবি করে, তাহলে তার বিরুদ্ধেও এই চুক্তির নির্দিষ্ট বাস্তবায়ন করা যেতে পারে। তবে যদি কেউ সদ্ভাবে এবং মূল চুক্তির বিষয়ে অবগত না থেকে মূল্য প্রদান করে সেই অধিকার অর্জন করে থাকে, তাহলে তার বিরুদ্ধে নির্দিষ্ট বাস্তবায়ন করা যাবে না।

ব্যাখ্যা: কখনও কখনও কোনো ব্যক্তি চুক্তির আগে থেকেই কোনো অধিকার দাবি করতে পারেন। যদি এই অধিকার বাদীর জ্ঞাতসারে থাকে এবং বিবাদীর মাধ্যমে এই অধিকার বাতিল করার সুযোগ থাকে তাহলে সেই ব্যক্তির বিরুদ্ধেও সেই চুক্তির নির্দিষ্ট বাস্তবায়ন করা যেতে পারে।
(d) when a public company has entered into a contract and subsequently becomes amalgamated with another public company, the new company which arises out of the amalgamation;
ব্যাখ্যা: প্রথম পাবলিক কোম্পানিটি যদি কোনো চুক্তি করে এবং পরবর্তীতে অন্য কোনো পাবলিক কোম্পানির সাথে এক্রীভূত হয়ে নতুন কোম্পানি গঠিত হয়, তাহলে সেই নতুন কোম্পানির বিরুদ্ধেও প্রথম চুক্তিটির নির্দিষ্ট বাস্তবায়ন করা যেতে পারে।
(e) when the promoters of a public company have, before its incorporation, entered into a contract, the company: provided that the company has ratified and adopted the contract and the contract is warranted by the terms of the incorporation.
ব্যাখ্যা: যদি কোনো প্রতিষ্ঠাতারা একটি প্রস্তাবিত পাবলিক কোম্পানির গঠনের আগেই কোনো চুক্তিতে আবদ্ধ হন, তাহলে পরবর্তীতে সেই কোম্পানি গঠিত হলে সেই চুক্তির নির্দিষ্ট বাস্তবায়ন করা যেতে পারে। তবে এর জন্য সেই কোম্পানির দ্বারা সেই চুক্তি অনুমোদন এবং গৃহীত হতে হবে।
