⇒ Extent: It extends to the whole of Bangladesh and applies to all judicial proceedings in or before any Court, including Courts-martial, other than Courts-martial convened under the Army Act, 1952, the Naval Discipline Ordinance, 1961 or the Air Force Act, 1953 but not to affidavits presented to any Court or officer, nor to proceedings before an arbitrator;

⇒ এই আইন সমগ্র বাংলাদেশে বলবৎ হবে ও ১৯৮২ সালের সেনাবাহিনী আইন বা ১৯৬১ সালের নৌ- শৃঙ্খলা আইন বা ১৯৫৩ সালের বিমান বাহিনী আইন অনুসারে গঠিত সামরিক আদালত ব্যতীত সকল আদালত এবং সামরিক আদালতে যাবতীয় বিচার কার্যে প্রযোজ্য হবে। তবে অত্র আইন কোন আদালতে অথবা কোন কর্মকর্তার নিকট উপস্থিত হলফনামা অথবা সালিসের কার্যধারায় প্রযোজ্য হবে না।

Judicial proceedings-The term "Judicial proceedings" is not defined by the Evidence Act, but it is defined by section 4(m) of the Criminal Procedure Code as a "proceeding in the course of which evidence is or may be legally taken on oath. "An enquiry is judicial if the object of it is to determine a jural relation between one person and another or a group of persons or between him and the community.

Departmental enquiries-In departmental enquiries the strict laws of evidence according to the Evidence Act are not applicable.
