Section: 22. Discretion as to decreeing specific performance:
The jurisdiction to decree specific performance is discretionary, and the Court is not bound to grant such relief merely because it is lawful to do so; but the discretion of the Court is not arbitrary but sound and reasonable, guided by judicial principles and capable of correction by a Court of appeal.

The following are cases in which the Court may properly exercise a discretion not to decree specific performance:-
I. Where the circumstances under which the contract is made are such as to give the plaintiff an unfair advantage over the defendant, though there may be no fraud or misrepresen-tation on the plaintiff's part.

II. Where the performance of the contract would involve some hardship on the defendant which he did not foresee, whereas its non-performance would involve no such hardship on the plaintiff.

III. Where the plaintiff has done substantial acts or suffered losses in consequence of a contract capable of specific performance.

সুনির্দিষ্ট প্রতিকার আইনের ২২ ধারা অনুযায়ী,
সুনির্দিষ্ট কার্যসম্পাদনের ডিক্রি প্রদানে এখতিয়ার হচ্ছে বিবেচনামূলক এবং কেবলমাত্র তা করা আইনসম্মত, এ কারণেই আদালত এমন প্রতিকার মঞ্জুর করতে বাধ্য না। আদালতের বিবেচনামূলক ক্ষমতা স্বেচ্ছাধীন হবেনা বরং নিখুঁত এবং যুক্তিযুক্ত, বিচার বিভাগীয় নীতি দ্বারা নিযন্ত্রিত এবং আপিল আদালত কর্তৃক সংশোধনযোগ্য হতে হবে। ২২ ধারায় ২টি ক্ষেত্রে আদালত চুক্তির সুনির্দিষ্ট বলবৎকরণের ডিক্রি না দিয়ে ক্ষতিপূরণ প্রদান করতে পারে। ১টি ক্ষেত্রে সুনির্দিষ্ট কার্যসম্পাদনের ডিক্রি দিতে যথাযথভাবে বিবেচনামূলক ক্ষমতা প্রয়োগ করতে পারে।
নিম্নলিখিত ২টি ক্ষেত্রে চুক্তির সুনির্দিষ্ট বলবৎকরণের ডিক্রি না দিয়ে ক্ষতিপূরণ [solatium] প্রদান করতে বিবেচনামূলক ক্ষমতা প্রয়োগ করতে পারে-

i. বিবাদির প্রতি বাদীর অন্যায় সুবিধা আছে;
যেখানে এমন পরিস্থিতিতে চুক্তি সম্পন্ন করা হয়েছে যে, তা বাদীকে বিবাদির উপর একটি অন্যায় সুবিধা প্রদান করছে, যদিও সেখানে বাদীর পক্ষ হতে কোন জালিয়াতি বা ভুল বিবরণ নাও থাকতে পারে।

ii. বিবাদির প্রতি কঠোরতা;
যেখানে চুক্তির কাজ সম্পাদন বিবাদীকে কোন কঠোরতায় বা কষ্টে জড়িয়ে ফেলবে যা বিবাদী বুঝতে পারেনা, অপরদিকে উহা না করলে বাদীকে এমন ধরণের কোন কঠোরতায় জড়াবে না। এই দুটি ক্ষেত্রে আদালত চুক্তির সুনির্দিষ্ট বলবৎকরণের ডিক্রি না দিয়ে ক্ষতিপূরণ প্রদান করতে বিবেচনামূলক ক্ষমতা প্রয়োগ করতে পারে।
